Absence of evidence is not equal evidence of absence. So the inability to produce sufficient evidence of a crime/offence does not equal that no crime/offence exists; it only means that crime may or may not be charged or prosecuted.
Precisely this.

It wasn't proven Acerbi didn't say anything racial. At the same time it wasn't proven he said anything racial and that's why they didn't want to punish him.

To me, no reason to doubt the authenticity of Juan Jesus's reactions on the pitch in that moment. To me it leaves a bit bitter taste on the mouth, from Acerbi's side. That he denies everything and thus invalidates everything Juan Jesus says.

Now hopefully we can put this behind us and acerbi can be more careful in future.
If anything, the outcome of this episode just empowered him. Just enhances his belief that Italy is more racist than not / he is privileged. He got away with it. Means that he can keep on going like this.

The not enough evidence is going hurt his image. a Straight not guilty would have been much better.
His image? 🤔 What image? Wasn't he doing fascist salutes at Lazio? I mean look at that photo of Kessie holding his jersey, surely not just a coincidence?

I knew nothing will happen. Good. I support our key player.
Because Italians don't really want to eradicate racism or because #MarottaLeague?

I'm only concerned about the team harmony and Thuram already expressed his unhappiness about it.

The situation is largely unchanged, it’s fundamentally the worst possible outcome, because it falls on not enough evidence, meaning it’s up to everyone to make their own judgment, this will cling to him for a long time.

He will not be permanently damaged.

I would have thought that the burden of proof in a criminal matter would be more onerous. If there was a lack of evidence regarding the racial abuse, how is going to prove it in criminal law proceedings?

Fundamentally you can’t. The problem with this case is lack of evidence, if no additional evidence emerge it would be futile to even try it in a criminal court case as it is far stricter in terms of evidence requirements. It requires additional evidence emerges and that seems somewhat unlikely.

the outcome is expected and fair. It doesn’t mean Italy is more racist than not. It just means the people in charge are rational and they don’t want to accuse people just to improve the country’s image and serie A image even if there is no evidence.

Thuram has no right to be unhappy about it. He didn’t even hear what Acerbi said. If he chooses to believe only people with the same skin color and creates harmony problem, then he’s the real problem. Just fking sell him, I don’t want dramatic guys.

wait wait.. Was Thuram unhappy about Acerbi? No, he just said that Acerbi should be with the club so that he could defend himself and explain what had happened. That it wasn't right time to go to the national team. I don't see anything wrong here unless I'm missing something.

You are not. People see what they want to see, just like they hear what they want to hear. Thuram did not hear what Acerbi said on the field, so just like any other sane and reasonable person,he said Acerbi should deal with it with the club.

It is. Criminal case would be impossible. As you need to prove beyond reasonable doudt. Sporting case only the most likely outcome was required.

This is beyond ridiculous. Some Asians got worse treatment (especially after Covid-19) and there's no such crybaby reactions. At most, it should be evaluated as a sporting case. Even if there's an insult, it's not a fucking crime.

You are very wrong in that assumption, as in the EU it is according to the crime laws in the different countries in fact listed as a crime. Discrimination and expressing yourself negatively towards others (based on skin colour, ethnicity, religion and so forth) is those a punishable crime, where I live up to two years of imprisonment in fact.

However most cases you get a slap on the wrist and a fine.

Chinese Indo like me is the worst. We got insulted and treated racist in our own country, when we go abroad to western countries, thats even worse. The point is being minority anywhere in the world always resulted racism treatment & inequality.
